The Supreme Court reduces the sentence of a man who raped his neighbor in front of her minor son in Playa Blanca in 2011

The High Court accepts the appeal filed by the defendant, against the criteria of the Second Section of the Provincial Court of Las Palmas, and releases him.

The Criminal Chamber of the Supreme Court has reduced the prison sentence imposed on Said Aboudrar from 15 and a half years to eleven for raping a woman in Playa Blanca in September 2009, in a house where her minor son was present. 

The High Court has accepted the appeal filed by the rapist's defense and has applied the Comprehensive Guarantee of Sexual Freedom Organic Law, against the criteria of the Second Section of the Provincial Court of Las Palmas, which had denied the review of the sentence

According to La Voz, the man has already been released. According to the first sentence that condemned him to prison, he should have remained in prison until March 2025.

Specifically, the events date back to September 20, 2009, when Aboudrar went to his neighbor's house where her ten-year-old son was also present. The man lay down on a mattress where the woman was sleeping, slapped and threatened the minor with death and sent him to his room. Then, he took a kitchen knife and woke up the victim, placing the knife on her neck and even cutting her thorax. 

According to what he himself acknowledged before the Provincial Court of Las Palmas in a trial held in 2011, after punching the woman several times in the face and head, he grabbed her by the neck with one hand, took off her pajama pants, tore off her panties and "penetrated her vaginally without any type of protection". Meanwhile, the victim tried to break free and asked for help. 

The woman needed almost a whole year to recover from the serious injuries she suffered after the sexual assault. Of those, she was hospitalized for 78 days.  

The accused, for his part, was a repeat offender, with four previous convictions. Of these, one for vehicle theft, two for injuries and one for damages. In 2011, the Prosecutor's Office requested 15 years in prison for sexual assault and another five years in prison for a crime of injury, although he was finally sentenced to 15 and a half years for a crime of sexual assault. Now, the sentence is reduced to eleven years. 

In addition, he has been sentenced to special disqualification from any profession, trade or activity, whether paid or unpaid, that involves "regular and direct contact" with minors, for five years after leaving prison. In addition, five years of supervised release after leaving prison.
