The Sixth Section of the Provincial Court of Las Palmas has dismissed the appeal filed by Pedro San Ginés against the decision of the Arrecife investigating court that admitted the extension of the complaint filed by the Minister of Health of the Cabildo of Lanzarote, Juan Manuel Sosa, against San Ginés himself and the councilors of the CC political group for the alleged falsification of the regulations of the aforementioned political group that was applied to support his expulsion from it.
In a recent resolution notified on December 15, the Chamber rejects the arguments of San Ginés' defense and confirms the criteria maintained by the Arrecife Investigating Court in the order of July 22, 2022, which admitted the extension of the complaint initially filed by Juan Manuel Sosa against Pedro San Ginés for alleged crimes of coercion and threats (to supposedly force his resignation as a councilor of the Cabildo and for the defendant to obtain a sufficient majority to reach the presidency of the Cabildo) to new crimes of document forgery and violation of fundamental rights derived from the "ad hoc" elaboration of a false regulation, according to the complainant, for having considered the instructor that these crimes are related to those initially reported.
This new decision of the Provincial Court endorses the investigation of the case that has been followed in the Courts of Arrecife, which is currently pending a decision on the provisional dismissal of the case after the appeal filed by the defense of the Minister of Health of the Cabildo considering that there are indications of criminality in the actions of San Ginés to bring him to trial for alleged coercion, threats, document forgery and violation of fundamental rights.
As will be recalled, it was precisely the Provincial Court that ordered that this case be investigated against San Ginés after the initial dismissal of the same by the investigating judge, who has now reconfirmed the appropriateness of investigating all the crimes reported by Sosa for their obvious relationship, related to the continuous pressures reported by the Minister of Health to force a change of government in the Cabildo.
