The dismissal of a worker in the Canary Islands who was scammed by the call scam is endorsed

Initially, it was considered unfair, but in the end, the TSJC sided with the company, considering that there was a breach of good faith on the part of the worker.

The Social Chamber of the Superior Court of Justice of the Canary Islands (TSJC) has considered the disciplinary dismissal of a worker who was a victim of the well-known call scam and sent 3,750 euros to strangers who impersonated his bosses to be justified.

The worker at an electronics store in Tenerife answered the phone on January 17, 2023, to a supposed manager from the headquarters in Portugal asking for the boss urgently.

As he was not there, the employee himself attended to him and was then informed about the imminent receipt by parcel of a shipment that had to be paid for at that time in cash.

The worker did not make any further inquiries, nor did he check if the call was real, and when he was asked how much money he had, he replied that 2,100 and expressed his concern because it was all they had, and then the scammer told him not to worry, that they would make arrangements to bring them more funds.

The employee also gave him his personal telephone number so that the alleged delivery could be made, and the scammer even simulated a conversation with the store manager after which he informed him that the difference could be covered by activating 85 prepaid cards, as he did.

Through his mobile phone, he sent the codes to the scammers, but half an hour later he began to suspect because the shipment did not arrive, so together with another colleague they tried to cancel the payment, without success, and then found that he was the victim of a scam, so he filed a complaint at the Police Station.
