The Second Section of the Provincial Court will try next May 17, in Las Palmas de Gran Canaria, a man accused of trying to kill his ex-partner in Teguise in 2015. The Prosecutor's Office is asking for Yovany Ernesto Pérez, who is charged with four crimes (attempted homicide, damages, resistance and threats), a sentence of 11 years less one day in prison.
The events that will be judged next week date back to August 22, 2015 when, at about 00:15 hours and "with the intention of attacking the life and physical integrity of his former sentimental partner", Yovany Ernesto Pérez "appeared at her home". According to the indictment, the defendant tried to access the house "by banging on the door, without succeeding", and poured into it "part of the diesel contained in a container that was outside the house", finally managing to "enter it by breaking one of the windows of the house".
Once inside, he went to his partner, pushed her "without causing injuries" and "took the mobile phone" she was carrying, "throwing it against the floor", says the Prosecutor's Office, which points out that, immediately afterwards, the accused sprayed "with diesel throughout the house, specifically the kitchen", where there was "a gas cylinder, the hallway and the living room", while telling his ex-partner "that he was going to kill her and tried to set fire to the curtains of the house".
According to the Public Prosecutor's Office, Yovany Ernesto Pérez did not achieve his purpose "thanks to the rapid intervention of the agents of the Local Police of Teguise, who immediately appeared at the aforementioned address". However, he caused "damage to the house", which has been "expertly valued at 234.53 euros".
Threats to Civil Guard agents
At about 1:45 a.m., while already in the cells of the Civil Guard of Costa Teguise, the accused "refused to cooperate with the agents" with "the intention of breaking the principle of authority and with a defiant and aggressive attitude".
According to the Prosecutor's Office, he repeatedly hit "the wall and the door of the cell", "urinated on them" and broke the lining of the cell's mattress", in addition to "threatening" the agents with phrases such as "I'm going to come back with friends and I'm going to kill you all", "I'm going to come with a backhoe to tear down the entire barracks" and "I'm going to tear down the barracks".
Also requesting compensation of 10,000 euros
Therefore, the Prosecutor's Office considers that the facts constitute a crime of attempted homicide, another minor crime of injury, a crime of resistance, and another minor crime of threats, requesting for Yovany Ernesto Pérez a sentence of 11 years less one day in prison.
Specifically, for the crime of attempted homicide, the Public Prosecutor's Office is asking for a sentence of 10 years less one day in prison, in addition to a ban on approaching his ex-partner within 50 meters or communicating with her by any means for 20 years. For the crime of resistance, the Prosecutor's Office is requesting one year in prison, while for the other two crimes only fines of 1,800 euros are requested in each case, making a total of 3,600 euros.
In terms of civil liability, compensation is requested for the victim of 10,000 euros for the moral damages suffered and 69 euros for the damages caused to her mobile phone. It is also requested that he face the damages caused to the house, which as mentioned above were valued at 234.53 euros.
