A national police officer has been subject to two serious sanctions after being identified on a street in Las Palmas de Gran Canaria next to a group of people who were consuming cocaine in public, without preventing it and using his professional ID card for the preparation of the drug.
The police officer appealed to the Superior Court of Justice of Madrid (TSJM), as he is stationed in the Spanish capital, which has just ratified the measures imposed by the General Directorate of the Police, which seek to suspend him from employment and salary for five months and twenty days.
The events took place when he was located by a police unit along with three other people, although the sanctioned officer denies the account and maintains that he had moved away from the group at a "considerable" distance to take a phone call.
He also stated that he was never aware that the others were consuming narcotic substances, let alone that they were using his ID card for it.
The five police officers who acted then supported this version and assured that he was away, that they did not see him taking drugs, but that when asked whose cocaine it was, one of them implied that it belonged to the police officer.
“I don’t know why I have to take the blame for this, this drug is not mine. It belongs to a coward who should be held responsible,” said the identified person while looking at the appellant.
The latter justified that they were using his ID card because he had shown it to a friend of his who was in the group so he could appreciate its deterioration and that he later forgot it while taking a call, but that he never knew they were using it to prepare the lines.
In his brief, he points out that in addition to the facts not being proven, the sanctions lack proportionality, as the resolution would have gone beyond what was stated by the agents themselves.
The State Attorney opposed the appeal, alleging its "lack of credibility, constant inconsistencies and changes of version" on the part of the agent and his acquaintance.
For this party, it is not credible to say that the sanctioned officer did not notice that barely 50 centimeters away several people with whom he had shared a vehicle shortly before were consuming drugs, and in fact, they believe that upon seeing the police unit, he picked up the phone and moved away.
He adds that it would be irrelevant if no substance was intervened with him or if he was not seen consuming, since the sanction was imposed for being next to people who were doing so without intervening and for having provided his ID for its preparation.
