The number six candidate on the Yaiza Siempre (YAS) list for the municipal elections this Sunday, May 28, Miguel Ángel Fernández Barrio, was convicted three years ago in Lugo for a crime of domestic and gender violence against his ex-partner.
The reported events date back to December 20, 2019, when Miguel Ángel Fernández went to his ex-partner's home to deliver their young daughter, who was six years old at the time. Fernández forced his way into the home. His ex-partner "did not want to let him in," but he "prevented her from closing the door and entered the house, starting an argument between them," as recorded as proven facts by the Criminal Court number one of Lugo, which convicted Fernández.
At that moment, the Court emphasized that, "with the intention of undermining the physical integrity" of his ex-partner, he "grabbed her tightly by the arms and managed to take her to the kitchen, where he pushed her against the table and then threw her to the ground, where he repeatedly hit her on the leg and right hip."
On March 31, 2020, the Criminal Court number one of Lugo convicted Miguel Ángel Fernández Barrio as the responsible author of a crime of mistreatment due to gender violence. The imposed penalty was 60 days of community service, deprivation of the right to possess and carry weapons for two years, a restraining order against his ex-partner, and a prohibition to communicate with her for three years, as well as the suspension of visitation rights with their common daughter until full compliance with the sentence.
An appeal against the sentence was possible, which was filed by the defense and responded to by the Second Section of the Provincial Court of Lugo last October 2020, when that Court reaffirmed the conviction against Miguel Ángel Fernández Barrio.
"There is a medical report, which although not immediately after the aggression, does reflect residual injuries compatible with the mechanism described by the victim, as determined by the forensic doctor, and the report of the social worker who receives the testimony of the injured party is also on record," the Provincial Court concluded in response to the appeal. "In that statement," the victim "reports that she did not tell anyone about that situation of sustained abuse over time, nor the events that occurred on December 20," the Court revealed.
"My ex-partner filed a complaint against me, but that was a long time ago. I was convicted, that was a false accusation and what I had to go through, I already went through. I don't have anything pending, on the contrary," Miguel Ángel Barrios responded when asked by La Voz.
