Judge Fiestras dismisses the last case pending against Pedro San Ginés

The senator of Coalición Canaria and former president of the Cabildo of Lanzarote states that "being aforado does not mean that the Supreme Court acquits the innocent"

The Court of Instruction number 4 of Arrecife, headed by Ricardo Fiestras, has declared the provisional dismissal of a judicial case opened against the former president of the Cabildo of Lanzarote Pedro San Ginés, senator of Coalición Canaria, and the former councilors of the Cabildo of Lanzarote Francisco Fabelo and Antonio Jesús Morales. 

This resolution comes after the Criminal Chamber of the Supreme Court ruled on September 17, 2024 to return to the Court of Instruction the case against San Ginés, which, due to his status as aforado, should be resolved by the High Court. In the aforementioned judicial ruling, the Supreme Court pointed out that it had not found evidence that met "a minimum dose of solidity to assume its competence."

In this new resolution, the Lanzarote court has highlighted that "the perpetration of the crime is not duly justified" and has pointed out "the absence of conduct that could be classified as criminal." It has also defended the "lack of sufficient evidence" to continue with the investigation.

In an order dated February 18, Judge Fiestras indicated that the statements of the accused, with "the testimonial statements attached to the proceedings and by the extensive and abundant documentary evidence" it has not been possible to verify "the existence" of "minimum reasonable grounds" for the case to continue. 

For his part, San Ginés, who was aforado by Coalición Canaria as a non-elected senator in the current legislature, has defended that "being aforado does not mean that the Supreme Court acquits the innocent, apart from the fact that in this case it was a local court that decreed the dismissal." Likewise, the former president of Lanzarote has indicated that "this is the only and last of the many complaints against me on which there had not yet been a judicial pronouncement of dismissal."

In a press release issued this Friday, in the middle of the controversy with Canal Gestión for another of the fronts that he left open after his work at the head of the Cabildo of Lanzarote, San Ginés testifies that this judicial order "closes a political, judicial and media legal hell, which concludes with the full dismissal of all cases without exception." 

San Ginés, who attributes his involvement in several judicial processes to "a political witch hunt" by the PSOE of Lanzarote, assures that "from now on" he will continue "working in the defense of the interests" of the Canary Islands and Lanzarote "without waiting for apologies that will not come. And let others occupy their time in fighting the justice that, finally, has been done to me."
