The Investigating Court number 2 of Arrecife, which has released on bail of 100,000 euros the alleged leader of an Irish criminal gang Gerry Hutch, known as The Monk, has not imposed "any other precautionary measure", such as the withdrawal of the passport or the prohibition to leave the country.
The reason for the decision, supported by a favorable report from the Prosecutor's Office and by the investigating magistrate when making the decision, is that the investigated person alleged in his appeal that he was going to run in an electoral process in Ireland.
In the interpretation of the Court, "the withdrawal of the passport or other measures limiting his movements would prevent his free access to the elections", causing "irreparable damage to his right to passive suffrage, which remains intact" and which could only be affected through a final judgment.
The Irish citizen is being investigated as alleged perpetrator of a crime of money laundering committed within the scope of a criminal organization.
Meanwhile, the other citizen who entered prison with him on October 25 remains in pre-trial detention.
