The Second Section of the Provincial Court of Las Palmas will judge next October those accused of stabbing to death a 56-year-old man in Lanzarote. Specifically, the Jury Tribunal will be formed after the summer, on October 4.
According to the Prosecutor's Office brief, the defendants R.H.M. and S.D. visited the victim's house, in Arrecife, with a large knife and engaged in a heated argument on March 1, 2022, around 9:30 p.m. The Public Ministry assures that the reasons for this dispute are not "sufficiently clarified."
The events occurred in the capital neighborhood of Maneje, specifically, on Maciot de Bethencourt street. The next day, the alleged perpetrators, aged 18 and 33, were arrested. As La Voz learned at the time, the house was routinely used as a "drug den."
According to the public accusation, knowing that they could cause his death, both defendants allegedly stabbed him in the left side, penetrating his chest cavity and damaging his left lung, pericardium, and cardiac viscera. This stab wound caused his death after suffering a hemorrhage.
After the stabbing, the deceased's brother tried to help him, but at that moment he allegedly received threats, knife in hand, from the alleged perpetrators.
The Public Ministry states that during the argument, R.H.M. and S.D. also kicked and hit the main door of the house with knives on several occasions, causing damage to the home worth 565 euros.
The Public Ministry is asking for each of the defendants 15 years in prison and absolute disqualification during the term of the sentence, as well as supervised release for 10 years after serving the prison sentence for the crime of homicide, followed by 24 months of fine, with a daily fee of 20 euros for the crime of damages and two years of prison and special disqualification for the crime of threats.
In addition, the Prosecutor's Office requests, in the event that the sentence is condemnatory, the expulsion from Spanish territory of S.D., of Moroccan nationality. In this line, it asks that he serve the entire sentence and that obtaining the third degree or parole replaces the rest of the sentence with expulsion from the national territory. In addition, the prohibition of returning to Spain within a period of ten years.
The defendants will have to jointly and severally compensate one of the brothers with 565 euros for the damages caused to his home, as well as the three brothers of the deceased with 120,000 euros for his death.
