Court and Prosecution do not oppose suspending the extradition of a defendant accused of raping his daughter ten times

The Audiencia Nacional (AN) has not opposed the possible suspension of the extradition to the United Kingdom for humanitarian reasons of an 80-year-old citizen detained in Fuerteventura, and claimed for ten alleged sexual assaults on his daughter when she was a minor, given his delicate state of health.

The crimes allegedly took place between 1999 and 2001, and under English law he could be sentenced to a maximum of ten years in prison for each of them, six in the case of Spanish law. 

The man was arrested on February 19, 2026, at 8:45 a.m. in Puerto del Rosario in compliance with an international arrest warrant and subsequently remained provisionally at liberty with the obligation to appear every fifteen days before the Court, among other measures.

However, the accused currently suffers from pathologies for which he uses an oxygen machine and requires a wheelchair to move. 

For this reason, the Public Prosecutor's Office and the Audiencia Nacional do not oppose the suspension of the handover for humanitarian reasons and leave the final decision in the hands of the Council of Ministers.

The events allegedly took place when the minor was between 14 and 16 years old at the family home in Wickford in Essex and in the family caravan in Lulworth Dorset. 

In April of this year, the defense of this man requested that the extradition be denied for humanitarian reasons, that a forensic report be prepared, and that "concrete, sufficient, and verifiable" medical guarantees be offered, proposing other less burdensome measures. 

The report was prepared by the Institute of Legal Medicine of Las Palmas and aimed to prove the existence of ailments, mobility limitations, and risks associated with the transfer to the United Kingdom as a consequence of the handover.

The Institute of Legal Medicine concluded that the pathologies are chronic, tend to worsen, he is polymedicated and has a permanent oxygen machine at home, both day and night, so long journeys are not recommended.
