Antonio González's family appeals the dismissal of the case for false accusation against Pedro San Ginés

The private prosecution, headed by Antonio González's daughter, has filed an appeal for reconsideration before the Second Chamber of the Supreme Court that ordered the dismissal of the case that judged the former president of the Cabildo of Lanzarote and current autonomous senator of the Canary Islands Pedro San Ginés (Canarian Coalition) for the commission of the alleged crimes of false accusation and false testimony.

This appeal is in addition to that of the Public Prosecutor's Office, which also appealed the dismissal of the case before the Supreme Court. In the document presented before the Criminal Chamber to which La Voz has had access, the private prosecution adheres to the appeal for reconsideration already presented by the Prosecutor's Office and states that the order "is not in accordance with the law."

The events date back to November 11, 2009, when the former president of the Cabildo of Lanzarote, the nationalist Pedro San Ginés, reported at 10:30 p.m. at the Costa Teguise Civil Guard headquarters several people, including the socialist Carlos Espino, José Manuel Páez and the administrator of Climafrical, Antonio González Medina, who died in April 2020, after suffering years of media attacks.

San Ginés reported that Antonio González and Climafrical had been hired by the administration "bypassing the procedures established for the awarding of contracts," as stated by the Public Prosecutor's Office in a previous document.

In a document to which La Voz has had access, the family of Antonio González defends that San Ginés, "in order to harm Carlos Espino, orchestrated a false action, which reaches Climafrical and its owner Mr. González. All this with knowledge of the falsehood" as San Ginés was aware of "the administrative contracting processes" and highlights that "the accusations are not supported by any official report."

In this line, the family of the deceased states that he was even asked for a bond of one million euros and that "the judicial procedure not only led to the closure of the company Climafrical, but also to the displeasure and personal deterioration of Antonio González who, after ten years in the dock, died."

The private prosecution defends that San Ginés pointed out Antonio González during his complaint at the Civil Guard barracks and added that he administered Climafrical and was a member of the PSOE of Lanzarote.

In addition, it emphasizes that the then president of the Cabildo of Lanzarote reiterated these accusations years later during his two statements in court, one in June 2011 and the other in October 2019.

The private prosecution indicates that, despite the fact that the aforementioned complaint was filed with the Benemérita in 2009, when the now senator was president of the Cabildo of Lanzarote, "it was not supported by his institution, but by the political party he represents," Canarian Coalition.

After that, in May 2010, the Tourist Centers, during the presidency of Pedro San Ginés, filed a lawsuit for this same case with a text that, according to the private prosecution, reproduced "identical paragraphs of the previous complaint," implying that "it has been prepared by the same hand."

"Inaccuracies" in San Ginés' testimony

In this line, it relies on the order issued by the Court of Instruction number 3 of Arrecife, which stated that Pedro San Ginés fell into "inaccuracies made" in his testimony.

Among them, he pointed out that although San Ginés said that it was the manager who informed him of the irregularities that led to his complaint, this could not be confirmed. He also highlighted that the CACT's own economic director assured that the work and invoices were correct and that the judicial experts concluded that the invoicing met the requirements.

In this sense, he also adds that there was no legal report on the alleged irregularities exposed in the complaint, nor "objective reports prepared and objective verified statements" in which to support the alleged irregularities.
