Admits to raping his ex-partner and accepts a 7-year prison sentence

The trial was to be held this Tuesday in Arrecife, but the defendant has reached an agreement and has ratified it before the Court

The defendant accused of sexually assaulting his ex-partner in an open field on the island has confessed to the events this Tuesday and has accepted a sentence of 7 years in prison, after reaching an agreement with the Prosecutor's Office.

The trial was to be held this Tuesday before the Second Section of the Provincial Court, but finally there was no hearing. Thus, the defendant only entered the room to ratify his confession and his agreement with the sentence.

Initially, the Public Prosecutor's Office was asking for 14 years in prison for him, for a crime of rape by oral means and another of threats, and after the agreement has reduced that sentence by half. The private prosecution, exercised by the victim, has also accepted that this be the sentence.

The ratification was carried out behind closed doors, to protect the woman's privacy, given that the accused was her partner.

The events occurred in May 2020, when the sentimental relationship had already ended. According to the Prosecutor's Office and as the defendant has acknowledged, he believed that he "could impose his will on the victim, having been her partner", and "forced her to perform fellatio", using violence to do so "with the intention of frightening her and breaking her will."

The defendant was arrested shortly after and has been in pre-trial detention ever since, so that time will now be deducted from the sentence.

The ruling will be issued in accordance with what was agreed and will become final, as the defendant has shown his agreement. The Prosecutor's Office also requested compensation for the victim, as well as a restraining order and a period of supervised release when he completes his prison sentence.
