The Valencian Community has enacted an Administrative Simplification Decree Law in accordance with the State Coasts Law, according to which no hotels may be built less than 200 meters from the coast of Castellón, Valencia or Alicante.
This was indicated by the Autonomous Secretary of the Presidency, Cayetano García, who assured that “no one will be able to build any hotel 100 meters from the coast, under any circumstances or under any concept. Hotels can be built 200 meters from the coast as very close. The uses that are foreseen between 100 and 200 meters are removable constructions”.
The Decree Law is in accordance with state regulations which in its article 23 regulates the easement of protection of the demarcation of the maritime land and which, as in the case of Valencian regulations, prohibits constructions dedicated or intended for residential construction.
The assumption included in the rule does not allow hotels or residential constructions, but rather other types of removable constructions (such as beach clubs or beach bars) and other activities, always with prior report from Coasts.
Therefore, the Valencian Community explains that there is no contradiction between the Simplification Decree Law and the Coastal Law project, which will be adjusted to state law, because "it respects the state coastal easement, and does not introduce any change or authorize any activity or construction that violates state competence."
The Coastal Law project, which is being processed, will include these parameters, taking into account the practical assumptions and the orography of the Valencian Community, as has been done in the Simplification Decree.
The Autonomous Secretary of the Presidency, Cayetano García, appeals for “technical issues to be left to the technicians and policies to the politicians.” For this reason, he has asked that “we stop engaging in demagoguery with something as sensitive as our coast and sustainability.”
