The Supreme Court has declared final the conviction imposed on MEP Luis Pérez Fernández, Alvise, to pay 10,000 euros in compensation to the Chief Superintendent of Police of the Canary Islands for unlawful interference in his rights to personal privacy and self-image with the publication of a message on Telegram.
The sentence refers to the dissemination on the account @AlvisePerez on Telegram, on March 1, 2023, of a message that contained the photo of Jesús María Gómez Martín along with an excerpt from his resume taken from the official Police website and another image of the police chief with his romantic partner posing in front of a mirror.
Along with that image, the following comment was published: “Here you have the recently appointed Chief Superintendent of Police of the Canary Islands by the PSOE along with another photo of someone who ¿looks like his twin? He was promoted after the Delcy and Ábalos suitcase scandal (during which he was in charge of the border post at Adolfo Suárez Madrid-Barajas airport that night). Guess which Court his sister is in. It’s not personal, politicians and mercenaries. I’m just sending a message: We’re coming for you. More tomorrow."
The publication was seen by tens of thousands of people and received more than 670 comments, many of them "insulting and degrading," the Supreme Court points out.
A court of first instance in Las Palmas de Gran Canaria considered that the MEP had committed an unlawful interference in the rights to personal privacy and self-image of the police chief and also held him responsible for the damage to his honor caused by third-party comments to his publication.
For all these reasons, he was ordered to remove the publication, publish the sentence, and compensate the injured party with 10,000 euros, in a ruling that was fully confirmed by the Provincial Court.
Now the Supreme Court makes that sentence final by dismissing the cassation appeal filed by the convicted party, to whom it also imposes the payment of the costs of the proceedings.
