The Canary Islands Justice System, the fourth least congested in the country

Since 2019, the Archipelago continues to have the highest litigation rate of all the autonomous communities

The judicial bodies of the Canary Islands registered in the second quarter of that year the fourth lowest congestion rate in Spain. Specifically, it presents a congestion rate of 3.03, while the national average is 3.24. In addition, it has the fifth best resolution rate in the country (0.93) and a pending rate (2.01) above the State.

In addition, the Archipelago continues to have the highest litigation rate of all the autonomous communities since 2019. In total, it registers 47.87 lawsuits per 1,000 inhabitants, followed closely by Catalonia and the Balearic Islands.

The statistics service of the General Council of the Judiciary published this Wednesday the data referring to the movement of cases in the judicial bodies during the second quarter of 2023, from April to June. The report reveals that the 211 judicial bodies of the archipelago began the period with 190,777 cases pending resolution (15.5% more than in the spring of 2022), received 105,925 cases (6.2% more), resolved 98,484 (-3.3%) and left 198,113 pending (+22.6%).

By jurisdictions, the 114 operational bodies in the Islands began April with 117,551 cases in progress (13.3% more than at the beginning of last spring), received 48,651 (+13.3%), resolved 42,269 (-2.5%) and left 123,753 in progress, 27% more than in June of the previous year.

The 105 bodies of the criminal jurisdiction in the Canary Islands had 43,875 cases in progress at the beginning of April (+5.8%), received 47,295 (+1.8%), resolved 46,340 (+2.2%) and closed the quarter with 44,756 cases in progress, 13.4% more than in the second quarter of 2022.

In the contentious-administrative order, where 12 bodies operate, in April the courts of the Archipelago began with 7,478 lawsuits in progress (2.4% more than in the same month of 2022), 2,319 cases were registered (-0.9%), 2,275 were resolved (-19.7%) and 7,614 remained pending (+10.1%).

Finally, in the 27 bodies of the island's social jurisdiction, 21,913 lawsuits were in progress at the beginning of April (22.3% more than in the same period of the previous year), 7,660 were initiated (-4.4%), 7,573 were resolved (-7.9%) and 21,990 were left in progress (+23.8%).

In the analyzed quarter, two distorting elements have come together, whose effects have not been homogeneous in the different territories. On the one hand, in some autonomous communities there has been a massive admission of procedures that had been pending as a consequence of the strike of lawyers of the Administration of Justice that took place in the first quarter of 2023, which has caused a greater increase in the entry of cases. At the same time, and with more incidence in some territories than in others, the strike of officials of the Administration of Justice in the second quarter of the year has caused a retention of procedures that have remained unassigned in the common registration and distribution services, which has affected a decrease in income.
