A retiree has managed to recover more than 23,500 euros in maternity supplement after claiming it before the courts in the Canary Islands. This right is included in article 60 of the General Social Security Law.
The Social Chamber number 11 of Las Palmas de Gran Canaria has confirmed his right to retroactively receive said supplement in the pension he has been receiving since July 27, 2016.
According to the law firm Unive Abogados, which handled the case, the National Institute of Social Security (INSS) initially denied this supplement. However, the Court states that the institution forced the citizen to go to court and acted "discriminatorily" by denying their right to access this supplement. At this point, the Court granted compensation of 1,800 euros.
In addition, the client will receive a total of 23,552.34 euros, which includes the time he was without receiving said extra. "This victory also implies a lifetime revaluation of 15% in his pension, since he has four children," the firm adds in a statement.
In this line, they add that "it is essential to highlight that the possibility of claiming the maternity supplement is open to those who meet the established requirements, which are: having accessed the pension between January 1, 2016 and February 3, 2021, and being parents of two or more children.
In addition, since February 2021, they highlight that the current regulations "could be infringing" European legislation by "unjustifiably hindering access to the supplement for all men, regardless of whether they are parents of one or more children, which opens the door to new claims."
