The law is harsh, but it is the law…

This general principle of law tells us that "the law is harsh but it is the law," that its application benefits the community and establishes procedural guarantees for all.

The discretion of the enforcer was established with written law and written law in ancient Rome, and thus when undue delay in a judicial proceeding, in a judicial proceeding, assists the accused in embracing the constitutional right to a public trial without undue delay (Article 24 of the Spanish Constitution), the non-compliance with this mandate generates patrimonial responsibility for the State, protected by Article 121 of the Constitution.

"Justice is not perfect. The judicial system fails. The system, as defined by the organic law of the Judiciary, has been profoundly nuanced by jurisprudence, which has relegated the harm suffered by the individual to a secondary role as a criterion for determining the right to compensation."

Is the current system the best possible system? "Claudio Garcia Vidales, trainee judge"

The stigma of moral and honor damages has battered the accused with a series of psychological impacts such as anxiety, depression, and social stigmatization throughout the entire judicial period.

The reputational damages that ruined the accused's prestige and image, jointly related and notably affecting their family environment, undermining their honor and generating distrust among their bosses in their professional activity and their neighbors, have been notable, pointing out that the spiritual need and comfort of their loved ones, thirsty for a sentence that would exonerate the accused, family members who defended and believed in the innocence of the accused and the unjust procedural delay, generated a long period of anguish, such as that which befell the elderly mother of the investigated, silently suffering the scorn and social injustice that such a situation generated and which lasted for so long.

Today, finally, July 3, 2026, and in light of the favorable outcome of the sentence, my brother Victor Sanginés Tremps has shed an unbearable burden and our elderly mother has finally found peace and justice.

A path to happiness begins after the struggle; perseverance has overcome the true arbitrary judge, which is the elapsed time that condemned an innocent person for all these years, leaving an indelible scar for life.

Dura lex sed lex, (the law is harsh but it is the law).
