The PSOE of Lanzarote will bring to the Plenary Session of the Cabildo a motion to demand the immediate opening of a sanctioning file against Amavir for the non-compliance with staff ratios in the residences of Tías and Haría, as recorded in the supervision minutes of the institution itself. The initiative also calls for the quantification and recovery of the economic damage caused to public funds by the staffing paid for and not effectively provided.
The spokesperson for the Socialist Group, Ariagona González, considers it “unacceptable that the Cabildo has reports documenting such serious deficiencies in the care of our elderly and that the informational file has ended up archived without sanction”. “Oswaldo Betancort must explain what he has done in response to these events and why responsibilities have not been demanded from the company,” she states.
According to the motion, twelve supervision minutes from the Tías residence, drawn up between February and May 2026, repeatedly show a much lower provision of gerocaregivers than required. In one of them, between two and six professionals are listed for 124 residents, when there should have been nine per shift. The document also points to the absence of a doctor for approximately one year and problems such as pressure ulcers, urinary tract infections, falls due to lack of supervision, and medication errors.
In Haría, the initiative includes a minute documenting non-compliance with ratios in several shifts, with only two direct care staff during the night, a lack of a doctor, and an episode of convulsions in a resident due to a medication error.
“Families have the right to know that their elderly receive the care they need. The lack of staff compromises that care and overloads the teams. The Cabildo has the obligation to enforce the conditions of the service and act on the non-compliance detected by its own technicians,” states González.
The PSOE recalls that, according to the tender documents, the non-compliance with personnel hiring obligations is classified as a very serious infraction and may result in a sanction of between 10% and 15% of the gross annual turnover. With the figures from 2025 included in the initiative, the combined amount would be between 294,118 and 441,177 euros, depending on the percentage finally applied.
In addition, the socialists request that the technical services compare the cost of personnel planned in the company's offer with that actually incurred in each center, to determine the amounts that correspond to claim. To this end, they propose requesting economic documentation, payroll records from the last five fiscal years, and the average workforce broken down by professional categories.
“Every public euro allocated to the care of our elders must be used to guarantee their well-being. If payment has been made for staffing that the company has not provided, the Cabildo must quantify that money and demand its return,” argues the spokesperson.
The motion also proposes that, if the breaches persist after the opening of the file and the request for rectification, the termination of the concession be evaluated in accordance with the conditions set out in the contract.
