The Contracts Court annuls Teguise's gardening tender for not complying with regulations

The administrative body rules in favor of the Association of Green Infrastructure Management Companies in its appeal against the tender documents for 3.8 million euros, which forces the City Council to restart the procedure.

The Socialist Party (PSOE) has regretted this Friday in a press release that the improvement of the gardens and green areas of the municipality "must continue waiting", despite the repeated announcements of the Government of Teguise, composed of Coalición Canaria (CC), Popular Party (PP) and the former councilor of Vox.

This circumstance occurs after the resolution of the Administrative Tribunal of Public Contracts of the Canary Islands of February 6 that confirms the nullity of the tender documents for the new contract, considering that the service specifications did not comply with current regulations. “This will force the tender to be initiated again,” stressed the municipal spokesperson, Marcos Bergaz.

The Court partially rules in favor of the Association of Green Infrastructure Management Companies (ASEJA) in its appeal against the tender documents for a contract worth 3.8 million euros (IGIC included) and lasting two years, which forces the procedure to be restarted and delays the improvement of municipal gardens.

According to the Court, "neither in the tender documents nor in any other contractual document in the file are the award criteria justified, the reasons that motivate their establishment and determination being unknown".

Consequently, the Court concludes that "the partial acceptance of the appeal filed is appropriate, with a declaration of nullity of the tender documents". Furthermore, it warns that "for the purposes of a new contract, the costs arising from the new Collective Agreement applicable to the staff must be taken into account in the calculation of the tender budget".

The tender, published in October by the Cabildo de Lanzarote commissioned by the municipal Government, was precautionarily suspended in January. Now, the Contracts Tribunal declares the nullity of its specifications and orders to restart the process, which will delay again the launch of the service.

Marcos Bergaz laments that "history is repeating itself," after a similar annulment in 2022, and highlights the follow-up and proposals of the socialist group on this matter. Thus, he recalls initiatives proposed to speed up the contracting of the service or to apply a shock plan in the municipal green areas while the new service is tendered, awarded, and initiated. "It is a shame both the local government's rejection of these measures and this new setback due to the annulment of the tender documents," he concludes.
