The president of the Cabildo, María Dolores Corujo, reported in the Plenary session held on Friday the start-up of the file for the resolution of the contract for the construction and operation of the Tahíche socio-health residence, due to "the continuous breaches of the company awarded the contract, UTE Residenza Sanitaria."
"Since December 2020, when the Teguise City Council granted administrative cooperation, the awarded UTE could begin the works. However, not only did it not start them, but it also approached the Cabildo in April of last year requesting the assignment of the contract in favor of a third company," explained the president.
The Cabildo points out that this request, despite being viewed favorably by the Institution to avoid delays, "could not be attended to because the law does not allow assigning to a third party an award in which at least 20% of the work has not been previously executed, or one-fifth of the concession period has elapsed."
"The request of UTE Residenza Sanitaria to assign the contract to a third party suggests that it does not have the capacity or interest to execute the work," the president has stated and explained that "given this situation, we have considered all the possibilities to accept the assignment request, but the current legislation is clear about it and prevents it."
Throughout her appearance, the president explained that "this is not the only breach by the awarded company, as two sanctioning files have been initiated against it so far."
Repeated breaches
The Cabildo points out that already in January 2021, given the company's inactivity, "a first requirement was made for it to justify the expenses incurred and provide the financial balance," since the previous government team "had advanced it an annuity of two million euros."
Subsequently, the Corporation continues to explain, in March and August of the same year, "the requested documentation is requested again, of which only a partial response had been obtained," and given the persistent refusal to provide the aforementioned documentation, the Cabildo points out that "a sanctioning file was initiated in November 2021."
The Cabildo of Lanzarote also explains that the second sanctioning file, initiated in December 2021, "was caused by the failure to correct the errors noted by the Technical Office of the Cabildo in the Basic and Execution Project presented by the company."
Monitoring report
In view of these antecedents, the Cabildo points out that on February 23, "a monitoring report was carried out regarding all the files related to the socio-health center of Los Calderones de Tahíche," in which the origin of "initiating the appropriate file for the resolution of the work and the operation of which UTE Residenza Sanitaria was the beneficiary" was concluded.
Due to this, the Corporation explains that on March 7, the president sent "a provision to the Contracting Service through which she requested the issuance of the mandatory report on the status of processing and possible resolution due to breach by the contractor of the socio-health Residence of Los Calderones."
"The constant breaches by UTE Residenza Sanitaria leave us no choice but to terminate the contract and proceed with a new award," the president concluded.
