Ecologistas en Acción warns of environmental and cultural risks in the new Land Law

The group has submitted allegations to the bill, criticizing the primacy of renewables and audiovisual studies over urban regulations and the possible covert legalization of illegal constructions

Ecologistas en Acción of Lanzarote have presented a "multitude" of allegations to the modified articles and, among them, they request the elimination of the prevalence of certain actions in the field of renewable energies over any current urban determination, without in any case allowing this provision to prevail over urban regulations that aim to protect the landscape, the environment, the agricultural use of the land or the cultural heritage.

They also consider that declaring the implementation of audiovisual studies to be of general interest poses a serious risk of territorial, environmental and urban unprotectedness under the justification of the strategic interest of the audiovisual sector. Such a declaration would entail the declassification of Protected Natural Spaces to convert them into theme parks or film sets. Regarding introducing the "discretionary" character in the authorization of sporting events in the natural environment, Ecologistas en Acción believe that it represents a serious risk for the protection of the valuable natural heritage of the Canary Islands and could evade the application of objective criteria and the requirement of preventive and corrective measures necessary to minimize the impact on ecosystems.

On the other hand, they argue that the provisional authorization of illegal constructions during the elaboration of a new plan may be the back door for the legalization of a multitude of illegal buildings (illegal hotels, wineries, etc.), through planning modifications and increased pressure on administrations and technicians to legalize the actions.

"It is striking that a proposal or draft Law, whose purpose, according to what is written in the Preamble, is to "protect, order, act and recover the land, as a valuable and scarce natural resource", does not mention from the first paragraphs the Cultural Memory contained in the Soil, the Memory of the Landscape and the Cultural Landscape, which may be indicating how far its wording is from the Cultural Heritage in the treatment of the soil, as well as a null sensitivity and lack of knowledge. The Soil is not only valuable because it constitutes an essential element that allows life to be developed in the Canary Islands, but it also preserves the insular experience, both natural - paleontological, modern and contemporary - and cultural, since it was first populated."

On the other hand, Ecologistas en Acción Lanzarote believes that the draft Law on updating lacks the necessary guarantees in terms of transparency and citizen participation, given the reduction of deadlines to present allegations or reports, the elimination of public consultation and the exemption of the mandatory environmental report in several projects or plans, in addition to the legal uncertainty generated by the abuse of ambiguous expressions.
