The Superior Court of Justice of the Canary Islands has announced this Wednesday that it reported "by mistake" that it was awaiting toxicological tests to bring more charges against the driver of the accident that occurred on June 9 in Tiagua, whose victim died hours later in the hospital. According to the TSJC, "there is no toxicological analysis" of the investigated, because "no one asked for it."
However, the TSJC has confirmed to La Voz that the magistrate of the Investigating Court number 1 of Arrecife considers the drug test that the Civil Guard gave to the driver after being arrested to be valid and in which he tested positive, as well as the breathalyzer test carried out by the Benemérita and in which he gave an alcohol level in exhaled air of more than 0.60 milligrams.
Even so, and despite the fact that the Civil Guard also accused him of a crime against road safety for testing positive for alcohol and drugs, for now the Investigating Court Number 1 of Arrecife only charges the driver with a crime of reckless homicide. However, the TSJC has specified that this does not mean that he will not finally be charged with another charge.
It must be remembered that the tragic event took place on the LZ-20 road, as it passes through the town of Tiagua, when Marco Antonio Murcia, known in Lanzarote for being a member of the rock band Tribu, was run over after getting out of the vehicle that he had just parked in the passable part of the shoulder. As a result of the accident, Marco Antonio was seriously injured, later dying in the hospital.
The car that ran him over fled the scene, being located moments later by the Tinajo Local Police, thanks to citizen collaboration, at a home in La Santa. Different units of the Rapid Intervention Group (GIR) and the Arrecife Traffic Detachment traveled there, who arrested the alleged perpetrator for two crimes. The alleged perpetrator of the accident, according to what the Benemérita reported at the time, was also related to the assault on two Civil Guard officers in July 2017 in La Santa.
