Three years in prison for the driver who killed Marco Antonio Murcia in a hit-and-run in Tiagua

He has reached an agreement with the Prosecutor's Office, which will be ratified next week before the Provincial Court. The accused was driving under the influence of alcohol and drugs and fled the scene, abandoning the victim.

The fatal accident that took place in June 2018 in Tiagua and cost the life of musician Marco Antonio Murcia already has a trial date, although the hearing will not be held. The accused, Graciliano E.H., has reached an agreement with the Prosecutor's Office and next Tuesday the 24th he will only appear before the Sixth Section of the Provincial Court to ratify it, confessing to the facts imputed to him.

In total, the Prosecutor's Office is asking for three years in prison for him, which is what the accused has accepted. Of those three years, two and a half correspond to a crime of manslaughter due to gross negligence, for driving under the influence of alcoholic beverages, and half a year more for another crime of omission of the duty of rescue. And after the accident he fled the scene, leaving the victim abandoned, who at that time was still alive.

According to the Prosecutor's Office in its indictment, the events occurred at about 12:15 hours, when the accused was driving on the LZ-20 road "with his psychophysical conditions diminished", after having consumed alcohol, cocaine and amphetamines. 

At that moment, when crossing the urban nucleus of the Travesía Tiagua, he ran over a man who was standing next to his vehicle. The victim was a well-known musician and resident of the island, a member of the rock band Tribu, who at that time was moving to his new house. In fact, he was taking his belongings out of the car, which was parked in front of the house.

 

Dragged the victim for 20 meters

The event shocked the island in its day, among other things because of the circumstances in which the accident occurred. And the victim was trapped in the undercarriage of the car and was dragged 20 meters, until the driver stopped. Afterwards, he resumed the march, leaving the victim lying on the road.

When the ambulance arrived he was still alive and was transferred to the Molina Orosa Hospital, although he died shortly after being admitted, due to the severity of the injuries.

As for the driver, citizen collaboration allowed the Local Police to find him after the event, being located at his home in La Santa, in Tinajo. As reported then, he was also related to an assault on two Civil Guard officers in July 2017 in La Santa. 

After his arrest, Graciliano E.H. was subjected to alcohol and drug tests, yielding a result of 0.88 mg of alcohol per liter of exhaled air and 8 ng/ml in cocaine and amphetamines in the saliva test.

In addition to three years in prison, the Prosecutor's Office is asking that he be prohibited from driving motor vehicles and mopeds for 3 years, 3 months and 1 day, which implies the loss of validity of his driver's license, which he would have to obtain again after that period.

As for the relatives of the deceased, they have renounced the financial compensation that could correspond to them, having already been compensated by the insurance company.
