The Sixth Section of the Provincial Court of Las Palmas will try this week in Lanzarote a defendant accused of repeatedly raping his partner's daughter in Arrecife during the victim's mother's absence.
The events date back to the period between December 2017 and January 2018 in the home where the alleged aggressor, the victim, and the victim's mother lived. The accused, taking advantage of the romantic relationship with the mother and the time she was away for work, raped the victim on several occasions using force.
After the sexual assaults, in March 2018 the accused was prohibited from approaching the victim within a distance of 300 meters and from communicating with her by any means during the judicial proceedings.
The Prosecutor's Office accuses him of a continued offense of sexual assault and requests for the accused a prison sentence of thirteen years and special disqualification for the exercise of the right to passive suffrage during the sentence. Likewise, it also prohibits the accused from approaching within 500 meters of the victim, or those of her relatives, her home, place of study or work or any other where she may be for a period of ten years longer than the prison sentence imposed, as well as the prohibition of communicating with the victim and her relatives.
Furthermore, after serving the sentence, the Public Prosecutor also requests supervised release for ten years, as well as the obligation to participate in sex education programs. He also asks that the accused be imposedspecial disqualification for public employment or office, profession, or similar activity that involves contactwith minors for ten years.
On the other hand, the Prosecutor's Office requests that, in case of conviction, the period of prohibition of approach and communication be deducted from the final sentence imposed. Finally, they request that the accused pay the procedural costs and indemnify the victim with 18,000 euros for the moral damages caused.
