Section Six of the Provincial Court of Las Palmas will try next Tuesday, December 3, a defendant accused of sexually abusing with penetration of a woman in Arrecife. In this case, the alleged aggression is not classified as a crime of sexual assault because the events occurred before the reform of the Law of integral guarantee of sexual freedom in October 2022, which eliminated the crime of abuse and unified it in different types of sexual assault.
The events date back to 10:00 p.m. on the night of December 17, 2019, at her home in Arrecife. According to the prosecution's indictment, while the family was sleeping and the victim was alone in her room, J.A.P.G. allegedly entered the bed with her, began to touch her over her clothes, and inserted his hand under her underwear, caressing her vagina.
The Public Prosecutor's Office states that at that moment, the victim tried to remove his hand and reproached him for his attitude. However, the accused did not stop and allegedly grabbed her feet to prevent her from getting out of bed. At that moment, "with the intention of satisfying his sexual desires," he allegedly partially removed his clothes, raised the victim's legs, and "lowered her pants and penetrated her" for five minutes until he ejaculated inside her.
The Prosecutor's Office classifies these acts as a crime of sexual abuse with penetration and requests eight years in prison against J.A.P.G., with special disqualification for the right to passive suffrage during the term of the sentence, a measure of supervised release for seven years, and the prohibition of approaching within 500 meters of the victim, her home, or any other place where she is, and of communicating with her by any means for 10 years.
In addition, it requests that he compensate the victim with 6,000 euros in respect of moral damages.
