The Prosecutor's Office is asking for 12 years in prison for a man accused of sexually abusing a 10-year-old girl in Arrecife. The events occurred at the end of 2016 and will be judged on May 24 by the First Section of the Provincial Court, which will travel to Lanzarote for the hearing.
The accused, Fernan Wallens Daza, maintained a "friendship" with the girl's father, which he allegedly took advantage of to abuse her on several occasions. According to the prosecutor, the first episode occurred in September 2016, when the defendant, who was then 59 years old, "was at a family reunion" at the victim's home.
"Taking advantage of the special relationship of trust he had with the parent and the girl's family, taking advantage of the fact that at one point he was alone with her" and "motivated by the desire to satisfy himself sexually, he touched her chest under her shirt", the indictment states.
Another episode at the defendant's home
A few days later, the defendant was left in charge of the girl and her brother, and when both were at his house, he asked the girl "to give him a hug". At that moment, according to the prosecutor, "he put his hand under her shirt, touching her chest, to which the girl responded by separating from the defendant."
"Moments later", the letter adds, when the defendant was "playing with the mobile phone and the girl approached to see the game, Fernan Wallens Daza told her to sit on his legs to be more comfortable, and at that moment, encouraged by the desire to satisfy his sexual appetite, he began to touch the girl, putting his hand through her pants and panties and inserted a finger into her vagina."
As a result of what happened, the Public Prosecutor's Office reports that the girl presents "specific fears of men who look like the defendant and of being attacked at home, forcing her to take actions to adapt her home and alleviate these symptoms."
In addition to 12 years in prison for a continued crime of sexual abuse, the Prosecutor's Office asks that the defendant compensate the victim with 30,000 euros "for the moral damages caused" and that a restraining order be imposed for ten years. Also, in the event that he is convicted, he demands that he be placed on supervised release for 8 years once he is released from prison.
