The popular jury has declared Tobías C. K. guilty of homicide, the German citizen accused of killing a man by throwing him from the terrace of a shopping center in Costa Teguise on May 28, 2023. The court considers it proven that he threw the victim, the British citizen Thomas Christopher J., and dismisses that he acted in self-defense, as it does not give credibility to his version that he was protecting himself from an alleged attack. However, the jury appreciates that the accused acted under the effects of alcohol and drugs at the time of the events.
After the verdict was announced this Thursday, the Prosecutor's Office has maintained its request for 12 years in prison and the payment of 120,000 euros in compensation, a request to which the private prosecution has joined, by applying the mild mitigating circumstance of substance addiction. For its part, the defense claims that the minimum penalty contemplated for these cases be imposed, which is between 10 and 11 years in prison.
