The Chamber number 5 of the Contentious-Administrative Chamber of the Court of Instance of Las Palmas de Gran Canaria has "substantially" upheld the lawsuit filed by the relatives of a 53-year-old woman who died after going to a health center in Lanzarote with symptoms compatible with a stroke.

The judicial ruling has ordered the Canary Islands Health Service to financially compensate her relatives and to pay the judicial costs. The ruling states that the woman was sent in 2023 from a Health Center in Lanzarote to the Emergency Department of the Doctor José Molina Orosa General Hospital with the suspicion of suffering a stroke.

The judicial ruling states that the death of Eulalia Cabrera Toledo, known as Laly, cannot be attributed to "lack of expertise" of the healthcare professionals, but rather that the ultimate responsibility lies with the Canary Islands Health Service. In 2023, the institution did not provide hospitals with the ability to consult the documentation generated in health centers. "It would have been crucial to respect (and activate) the stroke code," according to the background of the judicial ruling.
