Derecho al Techo has requested that the judicial bodies of the Canary Islands enforce the new decree-law that halts evictions of people in vulnerable situations and without housing alternatives before new evictions occur.
The organization points out that the Royal Decree-law contemplates the possibility of suspending certain evictions when the legally established requirements are met, even in proceedings where a resolution ordering the eviction already exists, as long as it has not yet been executed.
For this reason, Derecho al Techo has demanded that the evictions scheduled from this Thursday that may be affected by the new regulation be urgently reviewed before their execution, to verify if the legal conditions for their suspension are met.
Derecho al Techo has stated that it is not asking the Superior Court of Justice of the Canary Islands to order the suspension of all evictions or to interfere with the jurisdiction of the courts. "We are not asking the Court to do something that the law does not permit; we are asking it to ensure that the law that comes into effect tomorrow reaches the courts before the evictions reach the homes," it highlighted.
In this regard, it has pointed out that "it would not be acceptable for a person to be evicted from their home tomorrow, when a regulation that may establish protection mechanisms for their situation is already in force, without first verifying if they meet the requirements established by the law itself.
"We are not asking for privileges, we are not asking for that to be suspended which legally should not be suspended; we are asking for the law to be complied with and for that which legally should remain suspended not to be executed," they indicated.
Derecho al Techo has requested that the TSJ of the Canary Islands promote, within its powers, the necessary information, communication, and coordination measures so that the competent judicial bodies are immediately aware of the new regulation.
Likewise, it has demanded that it be guaranteed that, before carrying out any eviction that may be affected by the new regime, the circumstances of vulnerability, the existence or non-existence of housing alternatives, and the rest of the legally established requirements can be verified.
"We remind you that behind every file there is a person, behind every eviction there is a home, and behind every home there is a life," they indicated.
Therefore, they have warned that they will remain vigilant regarding the evictions planned in the Canary Islands from this Thursday and that they will demand that the new legal framework be effectively applied from the first day of its entry into force. "For the right to housing and against evictions without housing alternatives," they concluded.
