The number one court of the Instruction Division of the Court of First Instance of Arrecife has ordered the release of the three suspects who were detained and sent to provisional prison as alleged perpetrators of the gang rape of a woman on a dinghy on September 16.
The victim and the suspects arrived in Lanzarote after being rescued by Maritime Rescue on a difficult humanitarian mission. The boat they were traveling in sank, and the survivors were rescued by two Maritime Rescue boats and then transferred to the Port of Arrecife.
The suspects, three men aged 21, 25, and 30, were arrested upon the arrival of the boat at the port of Arrecife, when the victim informed the Rescue services that she had been sexually assaulted by several fellow passengers. Protocols were then activated to assist the victim, and testimony was taken from other passengers who witnessed the events.
The Court has decided to revoke the provisional detention ordered after the Public Prosecutor's Office alleged the possible lack of jurisdiction of the Spanish courts. The gang rape allegedly occurred twelve miles off Spanish territorial waters.
The thesis defended by the Public Prosecutor's Office is that the assault occurred outside Spanish territorial waters, was committed by non-Spanish citizens against a woman who is not of Spanish nationality.
This allegation is being studied by the specialized section on violence against women in Arrecife. The parties involved will be able to file allegations against this decision.
