The First Section of the Provincial Court of Las Palmas will judge next Monday, June 3, two defendants accused of sexually abusing two friends in Arrecife, for whom the Prosecutor's Office is requesting sentences of three and eleven years in prison.
According to the indictment, the events took place on December 27, 2017, when L.A.V.G. and A.H.G.H., both of legal age, met the two women, with "whom they had a relationship of friendship and trust", and "all together went to the home" of one of the accused, located in Arrecife. There, according to the Public Prosecutor, "they ate and consumed several alcoholic beverages" during the early hours of the 28th, which caused them to "have their psychophysical faculties severely diminished to the point of being deprived of their will, their capacity to defend themselves and to freely determine their sexual behavior being annulled."
Taking advantage of this circumstance, according to the Prosecutor's Office, L.A.V.G. tried to "kiss several times" one of the friends, "while the four were in the living room of the house, rejecting him on all occasions." Later, after "as a consequence of her state of alcoholic intoxication" she went to the "bathroom of the house", L.A.V.G. "followed her and took her to one of the bedrooms, where she lay down on one of the beds to rest."
However, the Public Prosecutor maintains that "with the intention of satisfying his sexual desires", L.A.V.G. "lay down on the same bed" as her and "began to grope her and kiss her in various parts of the body, managing to put his hand under the bodysuit she was wearing and thus touch her breasts and genital area", despite the fact that she "tried to pull his hand away and asked him to stop."
Meanwhile, the Prosecutor's Office affirms that the other defendant, A.H.G.H. took the other friend "to another room". There, "taking advantage of the state of drunkenness in which she was, in which it was impossible for her to offer any kind of resistance", he maintains that "he put her on the bed, took off her shoes, pants and panties and penetrated her vaginally." Then, adds the Public Prosecutor, "A.H.G.H. went in the company of L.A.V.G. to the room where" the other friend "was and with identical spirit, taking advantage of the state in which she was, kissed and groped her, trying to remove the bodysuit she was wearing."
Supervised release after serving prison sentences
The Prosecutor's Office requests a prison sentence of three years for L.A.V.G. for a crime of non-consensual sexual abuse, while for A.H.G.H. it requests a prison sentence of eleven years. And it is that, to this accused, in addition to attributing a crime of non-consensual sexual abuse for which he also requests three years in prison, he also imputes another of non-consensual sexual abuse with carnal access, for which he asks that he serve eight years in prison.
Likewise, the Public Prosecutor requests that the accused be imposed the prohibition of approaching less than 500 meters from the victims in any place where they are as well as their homes, workplaces or any other frequented by them, in the case of L.A.V.G. for three years as he is accused only of one crime and in the case of A.H.G.H. to six years, three for each crime that is imputed to him.
Similarly, if convicted, he asks that they be imposed supervised release after serving the sentences consisting of "the obligation to participate in sexual education programs, with a duration of two years for L.A.V.G. and seven years for A.H.G.H.
