The Sixth Section of the Provincial Court will try J.F.H.M. on October 9 in Arrecife. He is of legal age and has a non-reckonable criminal record. He is accused of an alleged crime against public health. The Public Prosecutor's Office is requesting a sentence of four years in prison and a fine of 4,500 euros, with twenty days of subsidiary personal liability in case of non-payment, in addition to the payment of court costs.
According to the indictment, the Public Prosecutor's Office considers that, before January 3, 2024, the defendant was engaged in the distribution of narcotic substances from a home located on Avenida Mancomunidad de Arrecife.
On January 3, 2024, a police unit entered the home with the authorization of its owner, after a presumed episode of physical assault. Inside, the agents found five packages of **cocaine,** with a net weight of 2.02 grams and a purity of 64.79%, as well as four plates and a fragment of cannabis resin that totaled 382.06 grams. A precision scale was also seized.
According to the indictment, the seized drug had an estimated value of 2,713.44 euros and was intended for distribution to third parties.
The Prosecutor's Office maintains that the events constitute a crime against public health as defined in article 368 of the Penal Code, referring to substances that cause serious damage to health. It considers J.F.H.M. the alleged perpetrator of the crime and does not appreciate any modifying circumstances of criminal responsibility.
