The court number 3 of the instruction section of the Court of Arrecife (former Court of instruction 3) has decided to postpone the testimony of the mayor of Arrecife, Yonathan de León (Partido Popular), scheduled for this Tuesday, after hearing the testimony of the person in charge of the CGI system in which traffic fines were allegedly irregularly annulled.
The person in charge of the GCI computer program also carried out the audit that pointed to the users who archived or canceled the files opened for traffic fines in the Local Police of Arrecife.
As explained by de León in statements to La Voz, after hearing the testimony of the person in charge of this system, the magistrate Silvia Muñoz decided to suspend the rest of the testimonies pending "a more exhaustive audit of all files".
On Tuesday morning, in addition to the person in charge of the CGI system, a Local Police officer, the head of the service, and three other Local Police officers also testified. These last three officers were involved in the annulment of a fine for a family car belonging to the mayor during the Drag Gala of the Arrecife Carnivals this year, which the Prosecutor's Office has also ordered to investigate.
The individuals who were summoned to testify as witnesses left the judicial premises after 3:00 p.m. on Tuesday. Furthermore, most of the testimonies of witnesses and defendants were postponed until further notice.
According to the mayor's version, the court only had a part of the annulled files until now, and the judge has requested all fines susceptible of having been irregularly withdrawn. In total, 2,300 traffic fines, which would have left a hole in public coffers of nearly 600,000 euros, since 2016.
Irregularities detected by the Local Police
The irregularities were initially detected by the Local Police of Arrecife, which informed the municipal authorities of the existence of annulled or canceled sanctioning files without an administrative record.
After this, Mayor de León ordered an internal investigation last fall, which led to an audit and several municipal reports that were sent to the Prosecutor's Office.
This audit revealed “the existence of numerous actions of annulment of sanctioning files carried out in the computer system, identifying the users who had executed said actions”.
For its part, the Prosecutor's Office considers that the facts could constitute crimes of prevarication and embezzlement.
