The San Bartolomé City Council has obtained the backing of the Justice system in the proceedings followed to prevent the installation of a mobile phone antenna in Güime.
The Court of Contentious-Administrative Proceedings No. 3 of Las Palmas de Gran Canaria has entirely dismissed the appeal filed by the company American Tower España S.L.U. against the municipal resolution that denied the urban planning license, confirming that the Consistory's action was fully in accordance with the law.
The ruling represents significant support for the management carried out by the government team since the operator registered the license application in 2020. From that moment on, the San Bartolomé City Council began an exhaustive technical and legal effort to analyze the file and defend its urban planning competencies, always maintaining the general interest and the commitment made to the residents of Güime as a priority.
The mayor of San Bartolomé, Isidro Pérez, highlights that "this ruling confirms that the City Council acted with responsibility and rigor. From the first moment, we assumed the commitment to defend the interests of Güime and to work to prevent this infrastructure from being installed in the planned location. Today, justice endorses that decision and shows that we acted correctly."
During these years, the government group has held various meetings with the residents of the area to inform them of the status of the proceedings and convey the municipal commitment to exhaust all legal avenues to prevent the implementation of the infrastructure at that site.
The Councilor for Urban Planning, Marlene Romero, explains that from this moment on, “the Technical Office of the San Bartolomé City Council will now proceed with the file for the restoration of legality, including the dismantling of the antenna, which had already been ordered but was halted by the courts.”
"We always told the residents that we were going to defend this cause to the end, and we have done so, even in the face of opposition within the council itself, which for a long time considered that this installation 'is done like in other places'," states Mayor Isidro Pérez. "This ruling is a satisfaction because it shows that the decisions of the San Bartolomé City Council were based on solid technical and legal criteria."
In this way, the ruling confirms the legality of the decision adopted by the San Bartolomé City Council and dismisses all arguments raised by the plaintiff company, which it also condemns to pay court costs. Although the sentence is not yet final and can be appealed before the Superior Court of Justice of the Canary Islands, the San Bartolomé City Council values this decision.
