The Sixth Section of the Provincial Court of Las Palmas will try, on January 28 and 29 in Lanzarote, a defendant accused of allegedly sexually assaulting a woman in a relationship that began consensually but turned violent.
The events date back to 6:00 AM on an October morning in 2022 when the accused F.B.S. and the victim were in the vicinity of a restaurant in Arrecife, where they decided to have sexual relations voluntarily and with the consent of both parties.
At one point during this sexual encounter, the victim asked F.B.S. to stop, an order that the accused ignored and continued to penetrate her vaginally without a condom and in an aggressive and brutal manner, despite the victim's repeated pleas.
After that, the accused threw her to the ground and continued penetrating her against her will while scratching her and grabbing her neck and breasts tightly without ejaculating.
F.B.S. **only stopped penetrating her when the victim managed to break free from him** and saw that she was crying inconsolably. This assault caused her a **bruise** around the areola of one breast, **two abrasions** on another, a **bruise on her neck**, and an erythematous area on the right lateral region (redness).
Furthermore, as a consequence of these events, the victim suffered psychological sequelae such as anguish, fear, bewilderment, panic, shame, discomfort, and unease
The Public Prosecutor's Office accuses F.B.S. of a crime of sexual assault and a minor offense of assault and battery. For the crime of sexual assault, it requests a sentence of ten years in prison for the accused, absolute disqualification from passive suffrage during the term of the sentence, a prohibition from approaching the victim, her home, her workplace, and any other place frequented by her within a distance of less than 500 meters, for a period of 20 years, and, in addition, a prohibition from communicating with her by any means, also for 20 years.
Likewise, he also requests supervised release for F.B.S. for 10 years and the penalty of special disqualification from any profession or trade, whether paid or not, that involves regular and direct contact with minors for 30 yearsRegarding the minor offense of assault, the Public Prosecutor requests a **fine of three months** for the accused, with a daily rate of 15 euros, and the corresponding subsidiary personal liability in case of non-payment. Furthermore, if found guilty, he will have to pay the costs of the trial.
He will also have to compensate the victim with €50,000 for moral damages and with €230.37 for the injuries suffered.
