The Second Section of the Provincial Court of Las Palmas will try next Wednesday, February 12 in Gran Canaria, a defendant accused of sexually assaulting and robbing a woman in Lanzarote. The events date back to July 2019 when I.L.L and three other unidentified men allegedly approached the victim in the vicinity of a hospitality establishment in the Tandarena shopping center on Islas Canarias Avenue in Costa Teguise.
According to the indictment of the Public Prosecutor's Office, the defendant I.L.L. approached the woman, who was under the influence of alcohol and with diminished faculties, and took her to a nearby beach.
The Prosecutor's Office accuses I.L.L. of sexually assaulting the woman, forcefully grabbing her head, bringing it close to his penis and forcing her to perform oral sex. Due to the victim's resistance, the defendant allegedly knocked her down with her head in the sand of the beach, took off her underwear and penetrated her vaginally. After that, he hit her head against a wall.
The Public Ministry states that, after that, the defendant allegedly stole the victim's mobile phone, an iPhone X, valued at 369 euros, which was recovered but not given to its owner, and a black backpack, a jacket, a wallet and two pairs of sunglasses, all of which were not recovered.
The public accusation points out that the victim was in a state of intoxication, with altered mental faculties and with the impairment of her sensory and motor functions when she was allegedly attacked by the defendant. In addition, it states that the woman suffered "multiple" bruises on different parts of her body, predominantly on her arms, cuts on the vulva and vagina, as well as moral damages such as anguish, bewilderment, panic, shame, discomfort and unease.
According to the Prosecutor's Office, the defendant sold the victim's mobile phone for 40 euros two years later in a shop in Arrecife.
The Ministry classifies the events as a sexual assault crime for which it asks for 15 years in prison, absolute disqualification during the term of the sentence, the prohibition of approaching the victim, her place of work or any other place frequented by her for 25 years, as well as the prohibition of communicating with her by any means.
When he gets out of prison he must serve ten more years of supervised release, with the prohibition of approaching her. To conclude, he must participate for ten years in sexual education programs. The Prosecutor's Office asks that the defendant, of Guinean nationality, be expelled from the territory once he is granted parole or accesses the third degree and that he does not substitute the sentence for expulsion from the national territory.
Meanwhile, for the crime of robbery with violence or intimidation, it asks that he be imposed the penalty of five years in prison. In addition, the Prosecutor's Office asks that he compensate the victim with 50,000 euros for moral damages and for the stolen and unrecovered objects. In addition, he must pay the owner of the shop where he sold the mobile phone the 40 euros he lost.
