A court releases on bail the accused of sexually assaulting a minor in Arrecife

The victim's mother reports that the teenager is afraid to go out since his release and has tried to take her own life on several occasions.

The Sixth Section of the Provincial Court of Las Palmas, headed by Judge Emilio Moya, has released on bail a 43-year-old man accused of sexually assaulting a 14-year-old with carnal access in March 2022 in Arrecife. 

The Court has ordered the immediate release of the accused, who must appear every 15 days a month and is prohibited from approaching and communicating within 200 meters of the minor, her home or any other place frequented by her. If he does so, he would incur a crime of breach of precautionary measure.

The minor's mother in statements to La Voz has rejected this judicial resolution and has indicated that "this is not justice". In addition, she added that the teenager does not want to leave the house and if she does, she does so accompanied, for fear of meeting the accused on the street. Added to this are the different attempts by the young woman to take her own life.

The reported events date back to Tuesday, March 15, 2022, around 9:30 p.m., when the minor was allegedly approached by J.A.E.Q. as she was heading home. 

According to the complaint, the man tried to give her a ride in his car first and, when the girl refused, he grabbed her by the arm and made her enter a doorway to take her to his home. There, he allegedly sexually assaulted her on the living room sofa and then in the bedroom, where he allegedly penetrated her. 

The accused had been in provisional prison without bail since March 20, 2022, after being decreed by the Investigating Court number 2 of Arrecife and later ratified by the Investigating Court number 1. 

The Chamber stated at that time that there were "sufficient and reasonable grounds for suspicion to believe him criminally responsible for the crime under investigation." In addition, he added that the accused, of Colombian origin, has a criminal record for various serious offenses committed in Spanish territory and does not have administrative authorization to reside in Spain." 

The order signed by Magistrate Jerónimo Alonso, where his imprisonment was decreed, stressed that the victim's statement was "clear, precise and consistent, as well as complete and unequivocal." 

Two years later, this past March 5, a hearing was held before the Court to determine whether to extend his time in pre-trial detention until the trial was held. 

The Chamber relies on the fact that "the authorities involved in a procedure shall be obliged to delay as little as possible the detention or provisional imprisonment of the accused or prosecuted."
