The Yaiza City Council has concluded the legalization process of other hotels whose license was annulled by the Superior Court of Justice, specifically the Hotel Natura Palace. As reported in a statement, the Consistory has already notified the property of the resolution of the Governing Board by which an urban license is granted to said building "after examining its legalization project, considering the regulations of the Supplementary General Planning Plan of the municipality and the tourist authorizations granted by the Cabildo of Lanzarote".
From the City Council it is pointed out that the legalization and granting of an urban license for a four-star hotel located on a plot of unconsolidated urban land in Montaña Roja has been favorably informed at the request of Yaiza Beach S.A, "because the building conforms to the parameters established in the General Plan of Yaiza, after compliance with the applicable tourism sector regulations".
The hotel establishment had a tourist authorization by resolution of February 20, 2002, with a category of 4 stars with capacity for 269 accommodation units, and 466 tourist places, and now the administration has proceeded to declare the building legalized "in accordance with current planning".
The City Council has collected nearly 350,000 euros for its legalization
Prior to the agreement of the Governing Board, the City Council required the promoter to pay a fee of 298,331.893 euros for the processing of the legalization file, according to the same, from where they explain that "the increase in buildability will be subject, as a concept of recovery of capital gains and prior to or simultaneously with the mandatory urban license, to the payment to the Yaiza City Council of 15% of the urban development derived from the increase in buildability applicable to the plot in question".
"Four-star or higher establishments may increase the buildable area by 20 percent provided that said increase is intended for common areas without, in any case, increasing the number of established places. The increase is found in common areas and not in surface area in the accommodation area", point out from the Consistory, from where they point out that "the property, in addition to the fee for processing the file, paid an amount of 47,964.37 euros for the increase in buildability of the plot in application of the incentives for common areas as a concept of recovery of capital gains".
Regarding the urbanization works, given the considerations consigned in the municipal technical report, "the obligation to execute urbanization works prior to the granting of the license is understood to be fulfilled", it is added from the Yaiza City Council, from where it is indicated that "the report from the municipal technical services concludes that the buildings defined in the documentation provided comply with what is permitted by the General Plan.
The Yaiza City Council concludes by stating that "it informs the Courts of Justice in a timely manner about the files of accommodation establishments with annulled licenses" and recalls that "the institution is obliged to execute the sentence, requiring the interested party to request the legalization of the building if it had not initiated it".
