The PSOE has requested technical and legal reports from the Tías City Council on the works being carried out at the Hotel Fariones. "We are concerned that the mayor, or his Councilor for Urban Planning, speak of possible illegalities while the work continues without the City Council taking any action," said the local secretary and spokesperson for the Socialist Group in the Council, Kalinda Pérez.
Specifically, the PSOE has registered a document in the Council requesting the delivery of a copy of the file of licenses of all kinds granted for the renovation of the Hotel Fariones. Likewise, the socialists have also requested technical and legal reports that clarify whether the works being carried out are covered by the license or licenses granted, with an express request for the Secretariat to report on the legal actions that the mayor must carry out to restore legality, in the event that the works do not comply.
The local secretary and spokesperson for the Socialist Group in the Council, Kalinda Pérez, has expressed her "concern" because "at the same time that statements are made by the government group, recognizing that works not covered by the license are being carried out, the works continue at full speed".
Sealed works and modifications to expand the project
In this regard, it should be remembered that last October the City Council sealed off part of the works that the businessman Juan Francisco Rosa is carrying out at the Hotel Fariones, specifically those in the pool area, after detecting that it had been demolished despite the fact that the works had been expressly denied at the time based on a negative report issued by the Heritage area.
To try to legalize these works, Rosa presented an amendment to the original project, but also presented two others, for new interventions that were not included in the original project. One of them is for a spa that he also intends to build in the hotel gardens and has led to a lawsuit in the courts. And it is that, upon not receiving authorization from the City Council, the businessman decided to file a lawsuit in the Courts.
The City Council asked to certify everything executed
Meanwhile, the City Council recently stated to La Voz that the property had been asked to certify the works carried out so far, both in the building itself - to see if it matches what had been authorized - and those that could have already been started to execute the modifications of the project that have not been authorized. As for the third modification, it would apparently be to intervene on the promenade, whose access is cut off precisely by this hotel. In this case, the work was also not included in the initial project that was authorized, but despite this it could have been started without permission.
However, the Councilor for Urban Planning of Tías, Saray Rodríguez, pointed out that for the moment the City Council could not intervene by sealing off other works again. And it is that, she pointed out that the new Land Law approved by the Government of the Canary Islands prevents ordering seals on unauthorized works until it is determined that they are illegalizable. And, in the case of the other modifications, they are still in the process of determining it.
The City Council also pointed out that the owner of the Hotel Fariones had been asked to present a joint project with the three modifications to determine if the whole exceeds the buildability allowed in the Modernization Plan of Puerto del Carmen, under which these works were authorized.
