The Prosecutor's Office of the Provincial Court of Santa Cruz de Tenerife has taken into consideration and forwarded to the Senior Investigating Court the complaint filed by the IR-Los Verdes group against the government group (PSOE) in the El Rosario City Council for alleged crimes of prevarication and influence peddling in the approval of the Partial Plan of El Varadero - subsequently annulled by a final judgment of the Superior Court of Justice of the Canary Islands-.
This was announced this Wednesday at a press conference by the spokesperson for IR-Los Verdes, Escolástico Gil, who pointed out that the Prosecutor's Office informed them last Monday of the decision to file a complaint in the same terms as that presented by this opposition group in April 2007. It warned of alleged irregularities in the processing of this urban project on land classified as rustic environmental protection in the Island Territorial Planning Plan (PIOT).
"We have no doubt that the entire administrative process in this case is plagued with demonstrable irregularities," said Escolástico Gil, who hoped that the judicial investigation will clarify why the mayor, Macario Benítez, and the Councilor for Urban Planning, Ana Lupe Mora, "have blindly led all the councilors of the PSOE to skip one by one the technical and political warnings" regarding this Plan - which has three judgments against it from the TSJC-.
Once the complaint has been filed by the Prosecutor's Office, it is now up to the Investigating Court No. 3 of Santa Cruz to open new preliminary investigation proceedings, after which it will be decided whether to dismiss the case or refer it to the Criminal Court, charging the government group with the alleged crimes reported.
Gil also indicated that IR-Los Verdes will appear in the process exercising public action as an immediate measure in the face of the open investigation.
