The General Plan of Yaiza does not contemplate any possible regularization for the Papagayo Arena hotel, whose license was annulled by Justice. This hotel "remains exactly the same as it was in the current planning". The hotel, with 12 floors, projected on the beachfront, "exceeded the number of authorized floors" and "invaded and completely eliminated public access to the sea".

This has been explained by the drafter of the planning, Jorge Coderch, in a press conference in Yaiza, in which he said that "it occupies a corridor that gives access to the beach". "At this moment, it is still on that pedestrian path", he pointed out.

Therefore, the drafter of the General Plan believes that "the situation should be reversed", but understands that this should not be contemplated in the General Plan of Yaiza. "It is a situation that violates urban planning, because it is placed on a public strip", he insisted.

For his part, the general director of Territorial Planning of the Canary Islands Government, Juan José Santana, has recognized that this building "fails to comply", but has added that solving this situation is not the responsibility of the Yaiza City Council. "Now the responsibility lies with the one who has it", he affirmed. However, he did say that "Coasts, if it wants to act, can do so".

In this sense, he pointed out that on this aspect there is "no change" in the General Plan and, therefore, "if there is a file in the judicial process, it will continue". In addition, Jorge Codercha has also stated that "some famous occupation that has appeared in the media for the occupation of free spaces is still a green area in the plan". "It is still maintained like this", he affirmed, although he did not detail any specific case.
