The Court confirms a sentence condemning a man to 10 months in prison for kicking his ex-partner in Arrecife

The second section of the Provincial Court of Las Palmas has dismissed the appeal filed by a man, who was sentenced by the Criminal Court Number 5 of Las Palmas to 10 months in prison for kicking his ex-partner in Arrecife. The Court has confirmed this ruling, which is now final, and has imposed on the convicted man the costs derived from the appeal.

The events occurred on May 25, 2009, at approximately 2:30 p.m., in a house in Arrecife. According to the judgment of the Criminal Court Number 5 of Las Palmas, the accused, of legal age and with a criminal record that has not been taken into account in this case, was at his home when his former romantic partner came to pick up their minor son, whom they have in common.

In the judgment, it was considered proven that "with the intention of undermining her physical integrity," the accused invited his ex-partner to enter the house. "Once inside, he pounced on her and kicked her in the left hip area while saying: I'm going to smash your head," according to the judicial ruling, dated September 26, 2012, which has now been confirmed by the Court.

Restraining order for two years

As a result of these events, the accused caused his ex-partner a contusion of the lower external abdominal region for which she required assistance, although she had no sequelae. The convicted man was arrested after these events and was deprived of his liberty for one day.

With the dismissal of this appeal, the sentence that condemned this man to 10 months in prison for a crime of mistreatment in the family environment is confirmed. The convicted man will also not be able to have or carry weapons for a period of two years, and during that time he will also not be able to approach within a distance of less than 500 meters of his ex-partner or communicate with her.
