The Contentious-Administrative Court Number 1 of Las Palmas has authorized the Arrecife City Council to enter one of the houses attached to the La Destila school, where Narciso Pérez resides. In an order dated March 25, the Court allows the City Council to enter house 2F.
As explained in the order, entry to this address will be carried out "by the personnel designated by the aforementioned institute, with the assistance, if necessary, of members of the Security Forces."
With this judicial resolution, the City Council achieves a great step towards being able to evict these houses, although two other houses attached to the school still remain occupied. The City Council is awaiting the judicial resolution regarding these two houses, which, according to La Voz, could be released shortly.
The City Council has finally received this good news, after an order dated November 15 from the Contentious-Administrative Court Number 5 of Las Palmas rejected the eviction of one of these houses attached to the La Destila school. In that order, the Court stated that "there is no place to accede to the judicial authorization" by which the City Council intended the "possessory recovery ex officio" of these houses.
It is worth remembering that after seeing the previous attempts to carry out the eviction frustrated, on October 1, 2012, the City Council opened a new path, unanimously approving this procedure in plenary session. At that time, the City Council was confident that if the residents did not leave the houses within a short period of time, the Court would issue an eviction order, which would be executed by the Local Police.
In that case, the Court rejected the claim of the Municipal Corporation, but now another Court has issued an order in which it does authorize the entry of the City Council into the house occupied by Narciso Pérez.
