This decision means returning the file to the opposition phase up to the moment of grading and keeping the test of part A of the opposition (written exam) and the test of part B1 (presentation of the didactic programming), as well as the reports issued by the educational Administration corresponding to exercise B2, and proceeding to grade the writing and the presentation and defense of the didactic unit or, where appropriate, to the evaluation of the report of the educational Administration.
In this sense, the Resolution upholds the appeals filed by the candidates and annuls the lists published on July 13 by the Selection Committee of the Infant Education specialty. The annulled lists are the following: list of all the candidates who have passed the opposition phase with the assigned definitive scale; list of all the candidates who have passed the opposition phase ordered by weighted global score, list of the candidates proposed as selected ordered by order of weighted score, in the selective procedures of entrance to the body of teachers and the lists of qualifications of part A of the opposition phase, published on July 5, 2007, of the Infant Education specialty.
The Resolution also annuls the "Guide of Procedures to be followed by the Infant School Tribunals: qualifications", elaborated by the Infant School Selection Committee, and leaves without effect the appointment of the tribunals, of the Selection Committee and of the Coordination Committee, and new tribunals must be appointed in accordance with base six of the call.
The administrative appeals filed by the participants in the aforementioned selective tests against the opposition phase referred to the alleged irregularities in the qualification criteria applied. In this sense, the Ministry of Education suspended by means of the Resolution of August 24 of the General Directorate of Personnel the selective process, where 1,980 people had participated for 275 places, upon verifying the existence of a guide of procedures to be followed that established criteria contrary to the bases of the call and to the principles of equality, merit and capacity in the access to the public function, by setting a maximum number of approved per each of the 34 tribunals and the note sections.
A new Resolution of the General Directorate of Personnel will determine the procedure that, with the presence of a public notary, guarantees the anonymity of the candidates in the qualification of the opposition phase.
It is agreed, finally, to dismiss the claims of nullity of the entire selective process called, as well as the claim to declare the nullity of the appointment of the 275 people proposed by the Selection Committee and that the places were covered by personnel belonging to the substitution list.
