Chamber 77 of the Superior Court of Justice of the Canary Islands, created to decide on the challenge of magistrates, has again upheld the challenge of the president of the Sixth Section of the Provincial Court of Las Palmas (and of the Provincial Court in functions) Emilio Moya Valdés, and against the magistrate of the same section Carlos Vielba Escobar in a case that investigates the president of UD Las Palmas, Miguel Ángel Ramírez, for his "intimate friendship".
The same Chamber had upheld a first incident of challenge promoted by the Public Prosecutor's Office with the same protagonists at the end of last March.
Chamber 77 has upheld the request of the Public Prosecutor's Office in appreciating "a relationship of intimate friendship" between the two magistrates and the investigated. To reach this resolution, it has relied on the recordings delivered by the Prosecutor's Office, of conversations between Miguel Ángel Ramírez and the former magistrate of the Sixth Section of the Provincial Court, Salvador Alba Mesa, which led to his entry into prison and to being removed from the judicial career after being convicted.
The estimated challenge prevents them from any intervention in another procedure that is followed in the criminal jurisdiction in reference to the businessman from Gran Canaria Miguel Ángel Ramírez.
Both the magistrates and the defense of Miguel Ángel Ramírez spoke out against the challenge, even the latter assured that it was "manifestly unfounded".
