The Third Section of the Provincial Court of Las Palmas has condemned the Albatros Costa Teguise Hotel to vacate the tennis courts that are part of the hotel establishment and hand them over to their rightful owner for having exploited them illegally for twenty years. This has been learned by La Voz as a result of the ruling issued last July, which has been appealed to the Supreme Court.
This judicial ruling of the Provincial Court has sided with the owner and complainant, who can dispose from that moment and, pending the resolution of the Supreme Court, of this property located in the El Majo urbanization. The Chamber has thus revoked the decision of the Court of First Instance number three of Arrecife that decided to dismiss the owner's lawsuit against the company AllTours España SL, owned by the hotel chain Allsun Hoteles.
The company that manages the Albatros Hotel has argued that they have been in charge of the resort for more than twenty years and possessed the two tennis courts with it. However, the rightful owner has been demanding for years to be able to access and use the tennis courts of the sports facilities.
The Provincial Court of Las Palmas has pointed out that AllTours España SL lacked "title that legitimizes its possession over the claimed property." The company could not provide any contract proving that this property was transferred and had the right to exploit it.
For his part, the legal representative of the complainant F.C.U, after the legal firm lbo.legal, which is based in Seville, does not understand that the Albatros Hotel "has ignored this fact for so long, forcing to execute legal actions against it instead of solving this issue peacefully and extrajudicially."
Likewise, the defense lawyer has stated that this judicial ruling, which affects the tennis courts of the Albatros hotel, could pose a problem for the hotel to maintain its four-star category. Which would be "a possible conflict with the Tourism Area of the Cabildo of Lanzarote."
Thus, the Albatros Hotel has not yet released the property and its owner gives it until December 5 to do so, otherwise warns that "it will proceed to its launch on February 2, 2024."
