He confesses to raping a woman in a car in Playa Blanca and accepts 5 years in prison

The man accused of raping a woman in Playa Blanca has confessed to the facts this Tuesday before the First Section of the Provincial Court, accepting a sentence of 5 years in prison. As planned, the trial has not been held, having previously reached an agreement with the Prosecutor's Office.

Gustavo Adolfo Mena has limited himself to ratifying that agreement before the magistrates, recognizing a crime of sexual abuse. Thus, he has obtained a reduction in the sentence requested by the Prosecutor's Office, which was initially 8 years in prison.

After the confirmation of the accused, the president of the Chamber has declared the sentence final, which will be dictated based on that agreement.

In addition to the 5 years in prison, he will be prohibited from approaching the victim or communicating with her for 10 years. She, on the other hand, has expressly renounced the compensation that could correspond to her.

 

The victim, without “reaction faculties”

The events occurred on June 10, 2018, around 6:40 a.m., when the defendant was in his car with the victim, who was asleep in the back of the vehicle.

“Upon observing that the victim was in a state of drowsiness due to the previous intake, that same morning, of alcoholic beverages, he stopped the vehicle and entered the back seat, where she was lying down,” stated the indictment of the Public Prosecutor's Office, which has been fully recognized by the accused.

Afterwards, “after verifying her state of lethargy, with her reaction faculties notably annulled,” he placed himself on top of her, took off her clothes and penetrated her vaginally, “stopping his action at the moment he realized that she was minimally regaining consciousness.”

The trial should have been held last May, but the accused did not appear at the hearing, claiming that he now resides in the Peninsula and that he did not have money to pay for the trip. The magistrates then ordered his search and capture, and when he was located, they set a new date for the trial, which finally has not been held.
