The Prosecutor's Office is asking for four years in prison for a man accused of assaulting a man in Puerto del Carmen and breaking five of his teeth, who will be tried by the Sixth Section of the Provincial Court on September 16.
According to the indictment, the events took place at approximately 1:00 a.m. on December 5, 2018, when the accused was in the Atlántico Shopping Center, located on Avenida de las Playas in the tourist town.
There, according to the Public Prosecutor, A.F. gave J.M. "a strong punch in the mouth and a kick in the leg" "causing him to fall to the ground", where he "continued to hit him, punching and kicking him in the mouth."
Compensation for the victim of more than 10,000 euros
As a result, J.M. suffered several injuries and lost five teeth, suffering "a slight-moderate aesthetic damage, in attention to the loss of symmetry and facial harmony, manifestly visible during the smile or when speaking."
The Prosecutor's Office considers that the events constitute a crime of injury and, in addition to requesting four years in prison for the accused, requests that he compensate the victim with 4,072 euros for the consequences derived from the loss of five incisors and with 6,832 euros for the aesthetic damage caused.
Two previous convictions
The accused has two previous convictions, one for a crime of resistance and another for a crime of drug trafficking.
Specifically, for the crime of resistance he was sentenced in March 2017 to a penalty of 160 days fine which, after being replaced by the subsidiary personal responsibility of 80 days in prison, was suspended for a period of three years. Regarding the crime of drug trafficking, he was sentenced in July 2019 to a penalty of one year and six months in prison, although it was also suspended for a period of three years.
In addition, these criminal records are not computable for the purposes of recidivism, as indicated in the indictment.
